Hoist & Crane Repair, Inc. agrees that it will visually inspect the units covered by this agreement or purchase order and will repair or replace any parts which such visual inspection should reveal to need action. HCR warrants that the repair work will be done in a manner consistent with normal industry practices & procedures.

HCR warrants that any parts we repair and sell under this agreement to the same extent as the manufacturer's applicable warranty. No others express warranty is given and no word or action of HCR shall constitute a warranty.

In the event of a failure upon receipt of notice from the buyer, HCR will promptly inspect the unit to determine whether the failure is covered by this warranty. Repair work will be done without charge if this is the case. If the failure is not covered by warranty, HCR will make the repairs after quote & approval. If requested to do so, it will be at normal rates. In no event will HCR bear the cost of downtime or repairs performed by others.

Because the inspection of equipment for repair is visual only, buyer shall have no right or remedy against HCR for failure or damage that results from a defect that such inspection could not have reasonably discovered.

This is intended by the parties as a complete and final expression of their agreement and is intended also as a complete and exclusive statement of the terms of the agreement.
